How To Get A Green Card Through A Job Offer

How To Get A Green Card Through A Job Offer
4/ 5 stars - "How To Get A Green Card Through A Job Offer" Second, to family-sponsored green cards, employment-based green cards are the most popular way for entrepreneurs to gain legal residence ...

Second, to family-sponsored green cards, employment-based green cards are the most popular way for entrepreneurs to gain legal residence in the United States.

Despite this ever-growing popularity, there are stringent regulations in place intended to filter applicants based on their skill set as well as the current needs of U.S. job market.

With that being said, there are effective strategies and ways to improve your chances of getting an employment-based green card through a job offer or other entrepreneurial endeavor. In this post, we’ll explore the best techniques for getting a green card through a job offer as well as tips to sponsor a foreign national, as a U.S. based employer.

Understand the Various Employment Categories

Each year, 140,000 visas are allocated for employment-based immigration visas. Within the broader category, however, are five preference categories. The first step in the process of learning where exactly you fit in.

First Preference (EB-1): Individuals with extraordinary ability, outstanding professors or researchers and international executives.
Second Preference (EB-2): Professionals holding advanced degrees or those with exceptional abilities.
Third Preference (EB-3): Skilled workers or professionals holding a least a bachelor’s degree.
Fourth Preference (EB-4): Individuals who fall under the ‘special immigrants’ category.
Fifth Preference (EB-5): Investors who invest between the U.S. $500,000 and $1,000,000, (depending on the employment rate) in a venture that creates a minimum of ten new jobs for citizens and/or permanent residents.
This a very basic outline of the five preference categories. There are many other qualifications which come into the equation, but it’s best to consult with an immigration attorney to get the details.

What happens when there are more qualified applicants than a category permits?

When this happens, the category is considered “oversubscribed” and the immigrant visas will be issued in chronological order until the category is reached.

Employers: Take the PERM Process Seriously

If you’re on the other end of the equation, as a sponsoring employer seeking a foreign national there are a number of hoops to jump through initially. One of the most important steps to complete the PERM Labor Certification process. This step, completed before the green card process, ensures the government that there are no willing and able citizens available to take the position. Here are three useful tips to accomplish it:

Create a Detailed Job Description for the Prevailing Wage

The DOL requires employers, during the PERM process, to send a job description so that they may conduct the necessary tests and determine the prevailing wage. When creating the job description, do your best to be focused in the position’s responsibilities and duties while still remaining conversational.

Industry-specific jargon should be avoided, especially since the DOL inspector may not understand it. In some instances, if your description is not sufficient, the inspector may request more information which inadvertently will cause delays.

Be Proactive with Posting Job Advertisements

Another important requirement, as the sponsoring employer, is to place ads in certain recruitment channels including:

State Workforce Agency (SWA) for 30 days
Two consecutive Sunday editions of a local newspaper
OR

A relevant professional journal
Internal job posting (in-house) for 10 consecutive business days
Maintain Records of all Advertisements and PERM Documents

It’s crucial to keep records of all PERM related documents and advertisements. The DOL has suggested that approximately 30 percent of petitions will be audited so if you are selected, it’s imperative to have all the necessary paperwork on hand. Cases that are not audited by the DOL but via electronic applications will normally receive a decision within 5-6 months after filing.

Applying for a Work Permit

An alternative course of action to work in the U.S. while your Immigration Petition for Permanent Residence or I-485 is pending is an Employment Authorization Document (EAD). There are a few factors that would make you eligible for an EAD, according to USCIS.

You may have work authorization resulting from your non-immigrant status, authorization to work for a specific employer due to your non-immigrant status or fall in a category which permits you to file. The best course of action really depends on your long and short-term goals for employment. If your desire is to work in the U.S. but not necessarily establish permanent residence, you may want to consider an EAD.

Seek Aid From a Qualified Immigration Lawyer

Whether you are a foreign national seeking permanent residence in the U.S. or a domestic employer looking to hire qualified employees from overseas, it’s always advised to consult a professional immigration lawyer. There are other immigration green card options available if you do not meet any of the aforementioned criteria.

For instance, the Green Card Lottery Program is held each year and provides 55,000 green cards to randomly selected applicants. Another possible path may be through family-based sponsorship or marriage to a U.S. citizen. Again, perform due-diligence by discussing all of your options with knowledgeable immigration professional.

Looking for ways to stay in control of your loan? Online account management is one of the many tools we offer to help make managing your loan easier. Make payments and view and edit your account details by registering for an account.
We created a guide to show you how online account management works, and help answer some frequently asked questions.

View your loan balance anywhere, anytime

It can be difficult to stay on top of your loan balance, especially when you have so many other bills or account balances that you regularly check. Log in to online account management from any device to view your current balance at a glance – it will be displayed on the main page.

Access your account details (loan term, interest rate, etc.)

Need to quickly access account details? Your account information can be found online, without having to call your branch. Login to your account, and from the main screen you should see your loan details listed under “account details”. The account details column outlines your original loan amount, your current balance, the day you opened the loan, the amount and date of your last payment, your term and annual percentage rate.

View your insurance products

Not sure if you’re covered? When you log in to online account management, any insurance products that you added to your loan will appear on the main screen.

Conveniently make payments online

From the main page, click “make a payment”, or click on the payments tab. You can choose whether you’d like to make a one-time payment or recurring payments. Plus, you have the option of paying your amount due, or choosing a custom amount.

Tip: Do you use several bank accounts? You can add multiple payment sources to your Fairstone account. You can view and edit your payment sources at anytime under the “payments” tab.

Never miss a loan payment – schedule one-time or recurring payments

Click the “payments” tab and select “scheduled payments”. Next, choose “add a scheduled payment”.  Enter your payment details including the date you’d like the payment to be made, the amount of the payment and payment source. You can also view any scheduled payments you’ve previously set up.

Tip: Schedule payments to come out on the day you are paid – the money will go towards your loan before you have a chance to spend it elsewhere.

Need to change your address or contact info?

There’s no need to call us to change your personal information – simply log in to your account to do so. Click the “profile” tab to view and edit your contact details. Next, select the details you’d like to update and save your information to complete your changes.

Interested in registering for online account management? It’s simple:

You’ll need your loan account number, which can be found on your loan documents, and your branch number to create an account. Find your branch number by using our branch locator tool.

Looking for more information? Check out our online account management FAQ to find the answers to your top questions. If you need more assistance you can send us email, or call us at 800-995-2274.

In April, we once again gave customers the chance to win the value of their loan (up to $10,000) through the BEST. LOAN. EVER. contest. One thing’s for sure – they were all happy to have some extra money in their pocket. Wondering what they did with their prize?
We caught up with our winners to see how they used their money. Let’s see what they spent their prize on:

Home renovations

One of our winners decided to put the money towards some home renovations. And we weren’t surprised to hear that! Since we first launched the promotion, 30 Canadians have won the value of their loan and we often hear they’ve put the money towards renovating their home. It’s a great investment that will reward them for years to come.

Paying off loans

Some of our winners decided to pay down their outstanding loans. Many put a portion of their money towards their Fairstone loan, and one winner also put money towards the loan for his bike. Paying off debts is definitely a great way to use any extra money, whether it’s prize money from a contest, a tax refund or an inheritance. Check out this article for tips on saving money on your loan to help pay off debt faster.

Vacations and dinners with loved ones

One winner shared that they’re using the money to pay for a family vacation. Another winner celebrated their win and used the prize money for a nice dinner with friends. Time spent with family and friends is invaluable – what a great way for our winners to use their prize!

Saved the money for something special

Some of our winners weren’t sure how they’d spend their prize, and put the money in a savings account until they found something special to spend it on.

One thing we found interesting - most of our winners spread out their prize money on multiple purchases. Many used a portion of their prize to pay off debt, and spent the rest on something more special like time with friends and family.

How does it feel to win $10,000? Here’s what our winners had to say.

Anthony was shocked to find out he won the – he’s never won anything before
Barbara celebrated the news with a glass of wine
Kyriakos described his reaction to the news as, “disbelief, shocked, surprised, happy”
Annette was surprised and happy to learn that she’d won
Anatoli was shocked, and shared that he’s never even purchased a lottery ticket, so winning his loan was very exciting
Meet our April 2018 winners here.

Could you be our next BEST. LOAN. EVER. winner?

Open or renew a loan before September 30, and you’ll be automatically entered to win the value of your loan up to $10,000. Already a customer? Just visit your local branch and fill out a ballot to win. Visit our BEST. LOAN. EVER. website for full contest rules.

Congratulations to our April winners, and good luck to everyone entering the contest in September!

What’s the best loan payment option? It really comes down to your budget and lifestyle. We’ve broken down the differences between our payment options, and explained each method so you can decide which might work best for you.
You want to save money on your loan, or you want to pay off your loan faster
We recommend: Biweekly payments

Bi-weekly and semi-monthly payments seem very similar at first, but bi-weekly payments can help you significantly reduce interest charges compared to other payment options. Bi-weekly payments are made every other week, meaning you make 26 payments a year. Semi-monthly payments are made twice a month, so you only If you’re already making semi-monthly payments, consider switching to a bi-weekly payment instead. You probably won’t notice the two extra payments, since the extra payment will only happen two months out of the year, and you’ll be able to pay off your loan faster.

Tip: Align your loan payments with your paydays – this is especially helpful if you’re paid bi-weekly.

You need a bit more control over your budget
We recommend: Semi-monthly payments

With a semi-monthly payment option, you’ll pay the same amount towards your loan every month. A lot of people find this payment option easiest to manage, since you’ll know exactly how much you’ll be paying each month. Another benefit of semi-monthly payments is the payment size; rather than a larger monthly payment, you’ll be able to spread out your payments into smaller amounts.

If you’re the type of person who forgets to put aside enough money for bills, a semi-monthly option may be better for you. An added bonus? The regular cadence of payments may also help you create strong budgeting habits.

Multiple payment deadlines overwhelm you and you sometimes forget to pay bills
We recommend: Monthly payments

The biggest benefit of a monthly payment? It simplifies your payment schedule – you only have to worry about one payment deadline a month. A monthly payment schedule is especially helpful for a debt consolidation loan. Most people find relief when they can simplify multiple bills and deadlines into one simple payment, helping them stay on track and in control of their loan.

Semi-monthly and monthly payment options also lend themselves to a more affordable loan payment. If bi-weekly payments aren’t fitting in your budget, contact your Lending Specialist to see if adjusting your payment option can help.

Did you know you can change your payment schedule at any time during your loan?

We understand your priorities might change throughout the life of your loan – simply contact your branch if you’d like to change your payment option at any time.*

One final tip that can help with any payment option is to set up automated recurring payments. Automated payments come out of your bank account on the day you choose, so you never have to worry about late or missing loan payments. Setup recurring payments through online account management or by contacting your local branch.

You should always carefully evaluate how much money you will need to study in the USA. Then you will need to research and apply for scholarships, financial aid from your school, and find money from any other source, including family funds. After exhausting these avenues, most international students still have a funding gap, and that's where international student loans come in.

What is an International Student Loan

Federal student loans are popular with US students studying in the US, but they are not available to international students. Instead, international students are eligible for international student loans, specialized private education loans available to international students studying in the US.

International Student Loans are now a very realistic way to finance your education in the US. Loans are very flexible, and can offer loan amounts high enough to pay for your entire education, but with extended repayment terms and reasonable interest rates, so you can afford the repayment after you graduate.

Cosigners

Most international students applying for loans must have a US cosigner in order to apply. A cosigner is legally obligated to repay the loan if the borrower fails to pay. The cosigner must be a permanent US resident with good credit who has lived in the US for the past two years. The cosigner is often a close friend or relative who can assist in getting credit, since most international students cannot receive credit on their own. If you're not able to find a cosigner see if there are no cosigner loans available to you.

Interest

Interest is the amount charged by the lender in addition to the amount of money that you borrowed. The interest rate is calculated based on an index plus a margin that will add an additional percentage interest rate depending on your co-signer’s creditworthiness. The two most common indexes used for international students are the Prime Rate and LIBOR Rate.

Prime Interest Rate – This index is determined by the federal funds rate which is set by the US Federal Reserve.
LIBOR – The LIBOR (London Interbank Offered Rate) is based on the British Bankers’ Association and is used on the London interbank market. The rate is an average of the world’s most creditworthy bank’s interbank deposit rates for overnight and one year terms.
When evaluating the loan, the lender will clarify which index the plan uses. Then, there will be an additional margin that will be added based on the borrower’s individual criteria, including the co-signer’s credit history. Based on their creditworthiness, an additional interest rate will be added to the index. This will be the total interest you owe. When your application is approved, your specific margin will be disclosed to you, at which point you can accept or refuse the loan.

Repayment

Repayment will vary depending on the loan option you choose. Since most international students are not able to work while they study in the US, repayment must be considered as an extremely important feature in your loan. You will need to consider how much the monthly payments will be, when payments will begin, and how long you will be able to defer paying back the loan. The repayment period generally ranges from 10-25 years, but the larger the loan, the longer the repayment period. The standard repayment plan options are:

Full Deferral – Students are able to defer payment until 6 months after graduation as long as full-time status is maintained. Students can defer payments for a maximum of four years, which is the typical length of a degree.
Interest Only – International students only pay the interest while in school, up to four consecutive years, and can defer the principal until 45 days after graduation, or when the student drops their course load to part-time.
Immediate Repayment – Payments on both interest and principal are due immediately once the loan has been dispersed.

Frequently Asking Questions

Who is eligible to apply for international student loans?

Students who are not US citizens or non-citizen permanent residents and who are attending an eligible US college or university may apply for international student loans.

What can international student loans be used for?

International student loans can be used for education-related expenses such as tuition, books, fees, insurance, and room and board.

What is the maximum loan amount I can apply for?

You can apply for up to the total cost of education, minus other aid, as determined by your school. In order to determine your maximum loan amount, you will need to contact your school’s financial aid office. After you apply and receive credit approval for you and your co-signer, your school must certify the amount of the loan.

When used responsibly as part of an overall education funding plan, international student loans can help to put a US education within reach, regardless of your financial circumstances. We offer two main loan resources dedicated to providing funding for international students: International Student Loan and Study Abroad Loans - please visit them for more information.
